7. Intellectual Property
7.1 PortalPage IP
The Service and its original content (excluding User Content), including but not limited to the PortalPage name, logo, website design, platform code, theme system, analytics tools, and all associated intellectual property, are and remain the exclusive property of PortalPage and its licensors. These are protected by copyright, trademark, and other intellectual property laws.
You may not use, copy, adapt, modify, prepare derivative works based upon, distribute, license, sell, transfer, publicly display, publicly perform, transmit, or otherwise exploit any PortalPage IP without our express prior written permission.
7.2 Your IP
We do not claim ownership over your User Content. You retain all intellectual property rights in any content you create, upload, or publish through PortalPage. The limited license you grant us in Section 5.2 does not transfer ownership of your content to us.
7.3 DMCA / Copyright Infringement
PortalPage respects intellectual property rights. If you believe that content on our platform infringes your copyright, please send a DMCA takedown notice to [email protected] with the following information:
- A description of the copyrighted work you claim has been infringed

We will process valid DMCA notices promptly and may terminate the accounts of repeat infringers.
8. Privacy
Your privacy matters to us. Our collection, use, and disclosure of your personal information is governed by our Privacy Policy, which is incorporated into these Terms by reference. By using PortalPage, you consent to the collection and use of your information as described in the Privacy Policy.
9. Third-Party Links and Services
PortalPage allows users to add links to external websites and integrate with third-party OAuth providers (Google, GitHub, Discord). These external services are not controlled by PortalPage.
We are not responsible for the content, privacy practices, security, or availability of any third-party websites or services. The inclusion of a link on a PortalPage profile does not imply endorsement by PortalPage of the linked site.
Your use of third-party services is subject to their respective terms of service and privacy policies. We encourage you to review those policies before using any linked services.
10. Service Availability and Modifications
10.1 Availability
We strive to provide a reliable and highly available service. However, PortalPage does not guarantee that the Service will be available at any particular time or free from interruption. The Service may be unavailable due to scheduled maintenance, technical failures, circumstances beyond our control (force majeure), or other reasons.

- Adding, changing, or removing features

We will endeavor to provide reasonable advance notice for material changes that significantly affect your use of the Service.

- IMPLIED WARRANTIES OF MERCHANTABILITY
- FITNESS FOR A PARTICULAR PURPOSE

- WARRANTIES ARISING FROM COURSE OF DEALING OR USAGE OF TRADE
PORTALPAGE DOES NOT WARRANT THAT:

- THE RESULTS OBTAINED FROM USING THE SERVICE WILL BE ACCURATE OR RELIABLE
- ANY DEFECTS OR ERRORS IN THE SERVICE WILL BE CORRECTED

Some jurisdictions do not allow exclusion of implied warranties, so some of the above exclusions may not apply to you.
13. Limitation of Liability
THIS SECTION LIMITS OUR LIABILITY TO YOU. PLEASE READ CAREFULLY.
TO THE MAXIMUM EXTENT PERMITTED BY APPLICABLE LAW, PORTALPAGE AND ITS OFFICERS, DIRECTORS, EMPLOYEES, AGENTS, AFFILIATES, LICENSORS, AND SERVICE PROVIDERS SHALL NOT BE LIABLE FOR ANY:
- INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, OR PUNITIVE DAMAGES
- LOSS OF PROFITS, REVENUE, DATA, BUSINESS, OR GOODWILL
- BUSINESS INTERRUPTION
- LOSS OF ANTICIPATED SAVINGS
- ANY OTHER PECUNIARY LOSS
ARISING OUT OF OR RELATED TO YOUR USE OF OR INABILITY TO USE THE SERVICE, EVEN IF WE HAVE BEEN ADVISED OF THE POSSIBILITY OF SUCH DAMAGES.
IN NO EVENT SHALL PORTALPAGE'S TOTAL CUMULATIVE LIABILITY TO YOU FOR ALL CLAIMS ARISING OUT OF OR RELATED TO THESE TERMS OR THE SERVICE EXCEED THE GREATER OF: (A) THE AMOUNT YOU PAID TO PORTALPAGE IN THE 12 MONTHS PRECEDING THE CLAIM, OR (B) ONE HUNDRED US DOLLARS ($100).
Some jurisdictions do not allow limitation of liability for certain types of damages, so some of the above limitations may not apply to you.
14. Indemnification
You agree to defend, indemnify, and hold harmless PortalPage and its officers, directors, employees, agents, affiliates, licensors, and service providers from and against any and all claims, liabilities, damages, judgments, awards, losses, costs, expenses, and fees (including reasonable attorneys' fees) arising out of or related to:
- Your violation of these Terms
- Your User Content
- Your use of the Service
- Your violation of any third-party right, including intellectual property rights or privacy rights
- Any claim that your User Content caused damage to a third party
- Your violation of any applicable law or regulation
We reserve the right to assume exclusive control of the defense of any matter subject to indemnification by you, at your expense. You agree to cooperate with our defense of such claims.
15. Termination
15.1 Termination by You
You may close your PortalPage account at any time through your account settings or by contacting us at [email protected]. Upon account deletion, your public page will be taken down immediately and your personal data will be deleted as described in our Privacy Policy.
15.2 Termination by PortalPage
We reserve the right to suspend or terminate your account and access to the Service, at any time, with or without cause, and with or without notice, including for:
- Violations of these Terms or the Acceptable Use Policy
- Conduct that we determine is harmful to other users, third parties, or our business
- Fraudulent, abusive, or illegal activity
- Extended inactivity (accounts inactive for more than 24 consecutive months may be subject to deletion after notice)
- If we discontinue the Service
For serious violations (e.g., illegal content, CSAM, security attacks), termination will be immediate without notice. For less serious violations, we will generally attempt to provide notice and an opportunity to remedy the issue before termination.
15.3 Effect of Termination
Upon termination: your right to use the Service ceases immediately; your public page is taken offline; your User Content may be deleted (subject to data retention requirements). Sections of these Terms that by their nature should survive termination shall survive (including Sections 5.2, 7, 12, 13, 14, 16, 17, and 18).
16. Governing Law
These Terms shall be governed by and construed in accordance with the laws of the jurisdiction in which PortalPage is legally established, without regard to its conflict of law principles. The United Nations Convention on Contracts for the International Sale of Goods does not apply to these Terms.
For users in the European Union, nothing in these Terms affects your statutory rights as a consumer under applicable EU law, including any rights that cannot be limited or excluded by contract.
17. Dispute Resolution
17.1 Informal Resolution
Before initiating any formal proceeding, you agree to first attempt to resolve any dispute, claim, or controversy arising out of or relating to these Terms or the Service by contacting us at [email protected] and providing a written description of the dispute and your desired resolution. We will attempt to resolve the dispute informally within 30 days of receiving your notice.
17.2 Binding Arbitration (US Users)
If informal resolution fails, any dispute arising out of or relating to these Terms or the Service (excluding disputes about intellectual property rights, which may be brought in any court of competent jurisdiction) shall be resolved by binding individual arbitration, not in a court of law. This means you waive your right to a jury trial.
The arbitration shall be conducted under the rules of the American Arbitration Association (AAA) Consumer Arbitration Rules, and judgment on the award may be entered in any court of competent jurisdiction.
CLASS ACTION WAIVER: YOU AND PORTALPAGE AGREE THAT EACH MAY BRING CLAIMS AGAINST THE OTHER ONLY IN YOUR OR ITS INDIVIDUAL CAPACITY, AND NOT AS A PLAINTIFF OR CLASS MEMBER IN ANY PURPORTED CLASS OR REPRESENTATIVE ACTION. Unless both you and PortalPage agree otherwise, no arbitrator may consolidate more than one person's claims or otherwise preside over any form of representative or class proceeding.
17.3 EU/UK Dispute Resolution
If you are a consumer resident in the European Union or United Kingdom, you may be entitled to submit a dispute to an alternative dispute resolution (ADR) body in your country. You may also access the European Commission's Online Dispute Resolution platform at ec.europa.eu/consumers/odr.

18.2 Severability
If any provision of these Terms is found to be invalid, illegal, or unenforceable, that provision shall be limited or eliminated to the minimum extent necessary so that the remaining provisions remain in full force and effect.
18.3 Waiver
Our failure to enforce any right or provision of these Terms shall not be deemed a waiver of such right or provision. A waiver of any provision in one instance does not constitute a waiver in any future instance.
18.4 Assignment
You may not assign or transfer these Terms or your rights or obligations under them, in whole or in part, without our prior written consent. PortalPage may assign these Terms without restriction. These Terms bind and inure to the benefit of the parties and their permitted successors and assigns.
18.5 Force Majeure
PortalPage shall not be liable for any failure or delay in performance under these Terms due to causes beyond our reasonable control, including natural disasters, war, terrorism, strikes, embargoes, internet outages, government actions, or other force majeure events.
18.6 Notices
Notices to PortalPage shall be sent to [email protected]. We may send notices to you via the email address associated with your account or via a notice on the PortalPage website.
19. Changes to These Terms
We reserve the right to modify these Terms at any time. When we make material changes, we will:
- Update the "Last Updated" date at the top of this page
- Send an email notification to registered users at least 30 days before the changes take effect for material changes
- Display a prominent notice on the PortalPage website
Your continued use of PortalPage after the changes take effect constitutes your acceptance of the revised Terms. If you do not agree to the revised Terms, you must stop using the Service and delete your account before the changes take effect.
